Terms of Service

1. Scope
These Terms govern your use of sitedia (the “Service”) in its UK edition. By using the Service you agree to these Terms.
2. The Service
sitedia generates site analysis diagrams, 3D models, sections, and sun, wind and thermal comfort simulations from public spatial data.
Basic features are available without an account. Pro features require a paid pass; the Plans page lists which features are Pro.
The UK edition covers Greater London for now. Coverage for buildings, heights, building age, parcels, planning designations and trees depends on the date, resolution and availability of the source data. Not every dataset exists everywhere: building age, for example, is shown only where an Energy Performance Certificate or a Colouring Britain record exists. The Data sources page lists every source.
3. Accounts
You may create an account with Google or with an email address. You are responsible for your account and sign-in details. Accounts may not be transferred or shared.
4. Paid passes
Pro features are used with a paid pass. Pass types, prices and periods are shown on the Plans page and at checkout. A pass is valid only in the edition where it is bought — a pass bought in the UK edition covers UK sites only.
A pass starts when your payment is confirmed and ends at the same time on the same date 3 months or 1 year later, depending on the pass. If that date does not exist in the final month, it ends on the last day of that month. If you buy a pass while another is active, the new period starts when the current one ends.
A pass is a one-off payment and does not renew automatically. Free features remain available after a pass ends. You must be 18 or over to buy a pass.
Passes are sold by Polar Software, Inc., which acts as the merchant of record and processes payments. Payment transactions are also governed by the Polar buyer terms. None of this affects your statutory rights as a consumer.

5. Your outputs
You may use generated outputs in coursework, reports and commercial projects, subject to the licences and attribution requirements of the underlying data.
A pass does not transfer any rights in third-party data, and does not allow you to extract or resell source datasets in bulk. Data that comes from OpenStreetMap (for example building outlines, streets, the walking network and some stations) is licensed under the ODbL 1.0, and these Terms do not limit your rights under that licence. Public sector information is used under the Open Government Licence v3.0; that does not mean the Environment Agency, HM Land Registry, Ordnance Survey, the Greater London Authority, Historic England or the Department for Transport endorse sitedia or your outputs.
Where sitedia shows an Esri basemap or aerial image (for example, the aerial view in the UK version), that content is for viewing inside sitedia only. You must comply with Esri's applicable terms of use (the ArcGIS Location Platform terms, available from Esri Legal): you may not download, extract, cache, or redistribute that content, and you must not remove or hide the Esri attribution shown with it.
Parcels are HM Land Registry INSPIRE Index Polygons. They show the indicative extent of registered titles, not legal boundaries; do not present an output as showing the legal extent of a property.
sitedia does not store your outputs in your account. Save the files you need to your own device.
When you show or distribute an output, include the Credits line shown under the diagrams.
6. Acceptable use
The following are not permitted. If they happen, we may restrict the account, after telling you the reason and how to challenge it.
- Getting around authentication or usage limits
- Accessing another person's account without permission
- Automated bulk requests that disrupt the Service
- Infringing other people's rights
7. Limitations
Outputs are references for early-stage design. They are not measured surveys, legal boundaries, structural or environmental certifications, or planning decisions, and they do not replace a planning application, Building Regulations approval or professional advice.
Planning designations come from the Greater London Authority, planning.data.gov.uk and Historic England. That data may be incomplete: a blank area does not mean that no designation applies. Check designations with the local planning authority before relying on them.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited by law, and nothing in them affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015.
8. Changes
If we change these Terms, we will announce it in the Service at least 7 days before the change takes effect (30 days if the change is to your disadvantage).

These Terms are governed by the law of the Republic of Korea. If you are a consumer living in the UK, you also keep the protection of the mandatory consumer law of the part of the UK where you live, and you can bring proceedings in your local courts (England and Wales, Scotland or Northern Ireland).
